Terms of Service

1. Service Description

NakshaAI provides the following digital services:

• AI Floor Plan (₹25 + GST): An AI-generated 2D concept floor plan based on your plot dimensions, room requirements, and preferences. This is a digital concept illustration intended for early-stage home planning. It is not a working construction drawing.
• Architect Plan (₹499 + GST): A floor plan prepared by our network of qualified architects based on your brief. The plan is a planning-stage drawing. Final construction must be carried out only after obtaining all required regulatory approvals and sign-off from a licensed structural engineer.
• Construction Cost Estimator (Free): An indicative cost calculator based on prevailing material and labour rates in your selected Indian state. Figures are approximate and not binding quotations.

NakshaAI reserves the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice.

2. AI Limitations and Disclaimer

Our AI-generated floor plans are produced using artificial intelligence technology (Google Gemini) and are concept illustrations only. They are intended to help you visualise a possible layout based on your inputs. By using the AI plan service, you acknowledge and agree that:

• AI-generated plans are not architectural drawings, structural drawings, or approved construction documents.
• AI plans are not reviewed or certified by any licensed architect or engineer.
• AI plans may contain imperfections, structural inconsistencies, or elements that are not feasible in actual construction.
• AI plans cannot be submitted directly to any municipal authority, development authority, or gram panchayat for approval.
• NakshaAI does not guarantee that AI-generated layouts comply with local building bye-laws, setback requirements, FAR regulations, or any other applicable standards.
• Vastu preferences included in your brief are incorporated on a best-effort basis. Vastu suggestions are informational only and do not constitute a certified Vastu Shastra consultation.

3. Architect Plan Services

Architect-prepared plans are produced by qualified professionals engaged by NakshaAI. The plan will be based on the brief you provide at the time of payment. You agree that:

• The accuracy and usefulness of the plan is dependent on the completeness and accuracy of the requirements you provide.
• The delivery target is within 24 hours of receipt of payment and complete requirements. Delivery may take longer if requirements are incomplete, require clarification, or if you submit after business hours.
• The delivered plan is a planning-stage floor layout. Structural drawings, electrical layouts, plumbing plans, and elevation drawings are not included unless explicitly specified in a separate service.
• You remain solely responsible for obtaining all required approvals from local municipal bodies, development authorities, or gram panchayats before commencing construction.
• NakshaAI and the architect who prepared your plan are not liable for delays, costs, or legal issues arising from regulatory non-compliance.

4. User Responsibilities

By using NakshaAI, you agree to:

• Provide accurate, complete, and truthful information when submitting plan requirements or contact forms.
• Use NakshaAI services for lawful purposes only and in compliance with all applicable Indian laws.
• Maintain the confidentiality of your account credentials and notify us immediately if you suspect unauthorised access.
• Not attempt to reverse-engineer, decompile, or extract the AI models or platform source code.
• Not use our services to generate plans intended for illegal construction or in violation of development regulations.
• Not copy, redistribute, or resell NakshaAI-generated plans without written authorisation for commercial purposes.
• Keep your contact and account information accurate and up to date.

5. Payment Terms

• All prices displayed on NakshaAI are GST-inclusive unless otherwise stated. GST (18%) is applied at the applicable rate.
• Payments are processed by Razorpay, a third-party payment gateway. NakshaAI does not store your payment credentials.
• Your order is confirmed only upon successful payment and generation of an order reference number.
• In the event of a failed payment, no amount is deducted from your account. If a deduction occurs without service delivery, contact us at support@nakshaai.com.
• Duplicate charges resulting from technical errors will be refunded in full. See our Refund & Cancellation Policy for all refund terms.

6. Intellectual Property

6.1 NakshaAI Platform

All software, design, code, branding, trade marks, and technology comprising the NakshaAI platform are the exclusive intellectual property of NAKSHAAI PRIVATE LIMITED. You may not reproduce, adapt, or exploit any part of the platform without express written consent.

6.2 Your Plans

Upon full payment, you are granted a non-exclusive, personal-use licence to the floor plan delivered to you. You may use the plan for your own home-planning purposes. You may not resell, sublicense, or commercially distribute the plan without our written authorisation. For the AI plan, intellectual property in the underlying AI model remains with NakshaAI and Google. For the architect plan, the concept drawing is prepared for your personal use.

6.3 User-Provided Content

By uploading reference images or providing plan requirements, you grant NakshaAI a limited, non-exclusive licence to use that content solely for the purpose of preparing your plan. We do not claim ownership of your uploaded content.

7. Prohibited Use

You may not use NakshaAI to:

• Scrape, crawl, or systematically extract data from our platform using automated tools without written permission
• Generate or request plans intended to facilitate illegal construction
• Attempt to gain unauthorised access to our systems, databases, or other users' accounts
• Upload content that infringes third-party intellectual property rights
• Impersonate any person or entity or misrepresent your affiliation
• Interfere with the proper functioning of the platform or its security measures
• Use the platform for any purpose that violates applicable Indian or international laws

Violation of these prohibitions may result in immediate account suspension and legal action where applicable.

8. Limitation of Liability

To the maximum extent permitted by applicable law, NakshaAI, its directors, employees, and agents shall not be liable for:

• Any loss or damage arising from your reliance on AI-generated or architect-prepared plans for construction without independent professional verification
• Any direct, indirect, incidental, consequential, or special damages arising from the use or inability to use our services
• Losses arising from regulatory non-compliance, unapproved construction, or decisions made without obtaining mandatory professional or governmental approvals
• Delays in plan delivery arising from incomplete requirements, force majeure events, or third-party service disruptions
• Data loss resulting from events beyond our reasonable control

In all cases, NakshaAI's total liability to you shall not exceed the amount paid by you for the specific service that gave rise to the claim.

9. Account Suspension and Termination

We may suspend or terminate your account without prior notice if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or used our services in a manner that causes harm to us or other users. You may request account deletion at any time by contacting support@nakshaai.com. Upon account deletion, your personal data will be removed subject to legal retention obligations.

10. Third-Party Services

NakshaAI integrates with Razorpay, Supabase, Google, and 2Factor.in. We are not responsible for the availability, accuracy, or privacy practices of these third-party services. Your use of any third-party service is governed by their respective terms and privacy policies.

11. Modifications to Terms

NakshaAI reserves the right to modify these Terms at any time. Material changes will be indicated by an updated "Last updated" date. Continued use of our services following changes constitutes acceptance of the revised Terms. We recommend reviewing these Terms periodically.

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved by good-faith negotiation. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts of India. For consumer disputes, you may also approach the appropriate Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019.
